What is a Process Server?

The word process derives from the "Process" of law", the mechanism on which a court case progresses. On many occasions for that process to continue one or more parties involved in the case must be served with various documents and this is known as Process Serving.

 

A process server delivers various legal documents such as;

  • summonses

  • injunctions

  • subpoenas

  • writs

  • witness orders

  • complaints

  • general orders

  • or other miscellaneous court documents

to one or more of the parties involved in a court case, which may be a;

  • claimant

  • defendant

  • respondent

  • witness

  • or other individual in some way involved in the case

 

When serving process documents the legal process server must affect service whilst complying with the court regulations and directions out of which they were issued and with any other legislation in the area in which the service is to be effected.

 

A process server may be directly employed and empowered by the court such as a Sheriff, Bailiff or Tipstaff. He may also be a professional private process server such as a Legal Inquiry Agent directly engaged by a lawyer or other individual.

Who can be a Process Server?

Any competent and reliable individual, generally over the age of 16 years, can become a process server and no qualifications are required. We provide all the training needed. However, it is the policy of our company not to engage persons under the age of 21 years as process servers.

 

Over the years we have found the people who are 'streetwise' with lots of common sense make, by far, the best process servers.

Why you should be a Process Server and the benefits

 

Process serving can be very financially rewarding in terms of the effort required.

 

Process serving is the ideal way to supplement your existing income. It is very flexible in that there is no set time to serve a process, which can often be done outside your normal working hours, or to suit your daily schedule.

 

Process serving is a satisfying and interesting occupation. Often it challenges your capabilities to successfully serve a set of process papers and gives a great sense of achievement when that goal is reached.

Do I need Training?

We will provide you with all the training and knowledge that you will require to effectively carry out the duties of a process server at no cost to yourself.

 

Any legal documentation that may be required in the course of process serving, such as Affidavits, Statements of Truth and reports, will be all prepared by our office.

 

Once you have established yourself as a competent process server, through our company, you can become a member of the National Association of Legal Process servers.

With some of the smaller islands it may be necessary for the process server to travel there from a neighbouring island. Therefore, their fees will reflect the extra time and costs and involved.
